HOW TO PRE-ORDER PROVOMEN COLLECTION

At the moment, you can pre-order men’s swimwear Provomen, which is expected to arrive in mid-late May 2020. By pre-ordering, you are one of the first to receive a limited pair of men’s swimwear.

The procedure for pre-order Provomen is quite simple. Select the color, then the size desired and hit the “proceed” button. You will see the selected item and size in the shopping cart.

ATTENTION there is a limitation on the pre-order of ten (10) pairs and four (4) pairs of the same color.

Fill in the contact information (if you are not registered on the Provomen website). Next you need to choose a shipping method and provide your details for the delivery and confirmation of pre-order. After that, choose a convenient payment method. When choosing payment by credit card, you can immediately make a payment on the site Provomen. The pre-order process is complete. Now you will get the confirmation letter of your order in your email. We will inform you the status of its implementation and shipping day as provided for in Section 4 below.

Do we notify that the goods ready to be shipped to you?After your order has been assembled and transferred to the delivery service, you will be able to receive the parcel on the date indicated in the notification (or according to the tracking number). Please note that we send pre-ordered pairs firstly. Provomen men’s swimwear collection is limited.

PRE-ORDER TERMS AND CONDITIONS

These Pre-Order Terms and Conditions (“Terms”) govern the placing of pre-orders (“Pre-Order”) with Provomen (“we”, “ us”, or “Provomen”) swimwear (“Products”). Please read these Terms carefully before submitting your Pre-Order. By submitting your Pre-Order, you agree to be legally bound by these terms.

PRE-ORDER RESERVATION

When placing a Pre-Order for Provomen men’s swimwear, you will be required to provide certain information, such as your address and billing information. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. Provomen shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct contact or shipping information. You can update your information at any time prior to your product being shipped by sending an e-mail to support@provomen.com

You acknowledge and agree that Provomen may decline or delay reservations to avoid oversubscription or as it deems appropriate, provided that we will make efforts to inform you within two (2) weeks of our receipt of your Pre-Order, and that you will be entitled to a full refund of the purchase Price.

PAYMENT

You will be charged the full Price of the Products at the time of placing the Pre-Order. If Provomen is unable to commence shipping the Products on or before the end of May 2020 of your placing the Pre-Order, Provomen shall process a full refund to you. Your placing of a preorder constitutes your express agreement to Provomen of charging the full Price of the Products at such time.

PRIORITY

Provomen will build/deliver Products according to the order in which the Pre-Order is received. This position does not imply receiving a particular number associated with your Products. If you cancel or forfeit your reservation in accordance with the terms of this Agreement, your position will be taken by the next person on the Product reservation list.

DELIVERY SCHEDULE

Although we will make efforts to begin delivering Products as soon as reasonably practicable, you understand and agree that there may be delays. An estimated time of delivery (ETD is end of the May 2020) is only an estimate, is subject to change, and Provomen does not represent or warrant that it will be able to ship the Product by the estimated date. As a result, in the event that a delay arises and the estimated shipment and/or release of the product is not met, Provomen is not responsible for any damages that may occur due to the delay, nor shall it be obligated, except as set forth in these Terms, to provide any discounts, refunds or credits due to any such delays. We will provide you periodical updates with respect to such delivery schedule. If for any reason you decide that you do not wish to continue to wait for your Product, you may cancel your reservation as provided for in Section 6 below.

PRICE

The purchase price (“Price”) is final. If your order is over €100 you will get free standard shipping.

CANCELLATION

You or Provomen may cancel this reservation by terminating the Pre-Order at any time for any or no reason prior to our notice to you that your Product is ready for delivery. If you do so prior to our notice of delivery, you will obtain a refund of the purchase Price without interest. If Provomen cancels your reservation you will receive a full refund of the purchase Price without interest (and you will not pay any processing fee).

LIMITATION OF LIABILITY

UNDER NO CIRCUMSTANCES PROVOMEN WILL BE HELD LIABLE FOR ANY INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OR RELATED TO THIS AGREEMENT. IN THE EVENT PROVOMEN IS HELD LIABLE FOR ANY DAMAGES ARISING OUT OR RELATED TO THIS AGREEMENT, YOUR SOLE AND EXCLUSIVE REMEDY WILL BE THE FULL REFUND OF YOUR PURCHASE PRICE WITHOUT INTEREST.

TERMS AND CONDITIONS OF PRE-ORDER

The pre-order of the Products is subject to additional terms and conditions provided by Provomen, including in respect of any software included in the Products or intellectual property embodied in the Products or data collected by the Products. The current Terms and Conditions of Pre-Order can be found in the footer of the checkout page and are subject to change without notice. Your pre-order of the Product will be subject to these terms and conditions and the refund policy.

RETURN POLICY

Provomen accepts returns of unused items within 14 days from the date of receipt. We require merchandise be returned in its original packaging, unworn and with all tags attached. Kindly try on all bottoms over your own undergarments.

Refunds on full priced items will be credited to the original credit card that was used to make the purchase minus the shipping fees. We are only able to accept merchandise purchased from the www.provomen.com.

Return packages must be shipped prepaid through a traceable method and those shipping costs are non-refundable. Please note: International customers are responsible for all additional shipping costs for exchanges as well as any taxes and/or duties related to your order.

Provomen reserves the right to refuse the return/exchange or any merchandise that does not meet the above requirements.

ELIGIBILITY

You acknowledge that you must be 18 years of age or older to register with us or use the Site and the Services. If you are under the age of 18 or the applicable legal age in your jurisdiction, you can use the Site or Services only in conjunction with, and under the supervision of, your parent or guardian who has agreed to the Terms of Use. If you do not qualify under these terms, do not use the Site or Services.

We will use any information that we may collect about you only in accordance with our privacy policy.

In order to register, you must provide certain personal information about yourself. The Provomen Privacy Policy explains the information practices that apply to this and other personal information we have about you, as well as any choices you can make about the ways this information is used. In accordance with the European Privacy Regulation 2016/679 we inform you that the data will become part of a file responsibility of Provomen.com in order to manage the purchase, delivery, service, the relationship or, where appropriate, the newsletter.

We are committed to protecting your privacy.
Any and all the information collected on this site will be kept strictly confidential and will not be sold, rented, disclosed, or loaned. We will give you the choice to refuse any future marketing emails from us.
We collect information about you for two reasons: firstly, to process your order and second, to provide you with the best possible service.

DISCLAIMER

PROVOMEN DISCLAIMS ANY WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE PROTOTYPE PRODUCT DISPLAYED BY PROVOMEN WHETHER BEFORE OR AFTER YOU HAVE PLACED THE PRE-ORDER. YOU UNDERSTAND AND AGREE THAT THE PRODUCT, ITS DESIGN AND TECHNICAL FEATURES ARE CURRENTLY AVAILABLE AND THAT THE PRODUCT MAY BE AVAILABLE FOR PURCHASE BY YOU MAY BE MATERIALLY DIFFERENTLY FROM THE PROTOTYPE PRODUCT. ALTHOUGHT PROVOMEN HAS MADE EVERY EFFORT TO DISPLAY OUR PRODUCTS AND THEIR COLORS AS ACCURATELY AS POSSIBLE, THE DISPLAYED COLORS OF THE PRODUCTS WILL DEPEND UPON THE MONITOR OF THE USER, AND PROVOMEN CANNOT GUARANTEE THAT THE USER’S MONITOR WILL ACCURATELY PORTRAY THE ACTUAL COLORS OF THE PRODUCTS. IF FOR ANY REASON YOU ARE UNHAPPY WITH THE FINAL VERSION OF THE PRODUCT, YOUR SOLE AND EXCLUSIVE REMEDY WILL BE TO CANCEL YOUR PRE-ORDER AS DESCRIBED IN SECTION 6 ABOVE.

CHANGES OF THE TERMS

Provomen reserves the right to change any of the terms for any or no reason. We will provide notice of any material changes and, if you are unhappy with such changes, your sole and exclusive remedy will be to cancel your reservation as described in Section 6 above.

MISCELLANEOUS PROVISIONS

These Terms constitutes the entire agreement between the parties pertaining to its subject matter and it supersedes all prior agreements, representations and understandings of the parties. This Agreement shall be governed by and shall be construed in accordance with the international law. The venue for any actions relating to the subject matter or enforcement of this Agreement shall be in the Ukraine country, the place were this Agreement was entered and is to be performed. You may not assign this Agreement or any of the rights granted to you hereunder.
